The 287(g) Program
The 287(g) program allows certain Tennessee law enforcement agencies to partner with Immigration and Customs Enforcement (ICE) to enforce the immigration laws in the country. Under Section 287(g) of the Immigration and Nationality Act, ICE can delegate certain immigration enforcement powers to local and state law enforcement agencies. The agencies given these powers enter into an agreement that outlines the scope of their authority and other details of the partnership.
Officers participating in the program receive resources and training from ICE and can question individuals about their immigration status. They can also potentially detain individuals based on violations of immigration law. The Tennessee Department of Corrections currently participates in the program, placing all immigrants in the state at risk.
ICE Holds
An immigration hold, also known as an ICE hold, occurs when ICE asks a state or local law enforcement agency to detain an individual for up to 48 hours after a person’s release from criminal custody, but only if there are no other criminal charges pending. The ICE request is usually made after someone has been arrested and ICE has reason to believe they should be deported.
It is important to note that an ICE hold does not automatically mean that a person will be deported. A hold can be challenged if a person is held longer than they should have been, or if their rights have been violated.

There has recently been an increase in Tennessee immigration enforcement actions, including traffic stops act have turned into immigration arrests, along with a rise in ICE partnerships with local law enforcement agencies. Between the Tennessee Highway Patrol and ICE, there have been over 100 people arrested and detained. Clearly, these operations have created anxiety and fear in immigrant communities.
